Terms of Service

OldPhoto Repair is a product name of, and is operated by, Elowin Labs LLC. References to “OldPhoto Repair”, “we”, or “us” mean Elowin Labs LLC doing business as OldPhoto Repair. By using this site you agree to these terms. How your photos and your data are handled is described in the Privacy Policy, which forms part of these terms.

OldPhoto Repair repairs, colorizes, and enhances photographs using automated tools. When you submit a photo, we process it to fulfill your request and return the result. Photos are deleted when processing is complete. Nothing about a visit is stored in your browser: leave the page and the work is gone.

There is no signup, no watermark, and no paywall on downloading your result. To keep the service free, we may limit how much it is used. We may change these limits at any time.

You must be at least 13 years old to use OldPhoto Repair, or older if the law where you live requires it. The service is not directed at children under 13 and we do not knowingly collect their personal information.

You keep every right you already had in the photos you submit. You grant us only the narrow, temporary permission needed to run the repair you asked for and send the result back to you — nothing more. We do not store your photos, publish them, share them, sell them, or use them to train models. That permission ends when the response is sent.

You are responsible for having the right to submit each photo. Do not upload photographs you have no permission to use, and be thoughtful about images of other people.

You agree not to use OldPhoto Repair to do any of the following. The same rules are in the Acceptable Use Policy.

• submit any sexual content involving minors, or any content that is illegal to possess or distribute where you are — this is an absolute limit, and accounts of it are referred to the authorities where the law requires;
• submit pornographic or otherwise sexually explicit material to our servers for repair;
• submit images you do not have the right to submit;
• create material intended to deceive — passing an automated reconstruction off as an authentic photographic record of something that did not happen;
• work around usage limits or other technical controls, including by scripting the tool or running it as a batch service;
• resell, rebrand, or mirror the service or the models it serves;
• attack, overload, probe, or interfere with the site or the people using it.

We may block access, refuse a request, or shut the service off if we believe any of this is happening. Photos may pass an automated content check before they are processed. We keep nothing either way, and no human reviews your photos.

Restoration is a reconstruction, not a recovery. The models infer plausible detail — faces, colour, texture — that was not present in the original, and they can be wrong in ways that look convincing. Do not treat output from this tool as evidence, as an identification, or as a factual record. Keep your originals; judge every result with your own eyes before you rely on it.

If you join a waiting list — for batch restore, the API, or the MCP server — you are giving us an email address so we can tell you when that thing exists. That is all it is: no commitment on either side, no charge, and no promise about what it will include or when it will arrive. You can ask us to remove your address at any time.

The site, its copy, its design, and the OldPhoto Repair name and marks belong to Elowin Labs LLC. Restoration models used by the service remain the property of their authors. Your results are yours.

We use service providers to host the site, process photos, protect the service, and measure usage. The Privacy Policy explains how information is handled. We are not responsible for third-party services beyond selecting them with reasonable care.

This is a free service run on a budget. We may change it, limit it, interrupt it, or discontinue it at any time, without notice and without liability to you. Nothing here is a guarantee of uptime.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY RESULT WILL MEET YOUR EXPECTATIONS OR ACCURATELY DEPICT ITS SUBJECT.

TO THE FULLEST EXTENT PERMITTED BY LAW, ELOWIN LABS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, IMAGES, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE, AND THEY REFLECT THE FACT THAT THE SERVICE IS PROVIDED FREE OF CHARGE.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is so, the exclusions and limits above apply only to the extent the law allows, and nothing in these terms limits any right you have that cannot be waived. Keep copies of your originals — a free web tool shouldn't be the only home of a family heirloom.

You agree to cover Elowin Labs LLC for any claim, loss, or expense that arises because you submitted a photo you had no right to submit, or otherwise used the service in breach of these terms.

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and the courts located in Palm Beach County, Florida have exclusive jurisdiction over any dispute. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-protection rules of your own country, nor of the right to bring proceedings there where the law gives you that right.

We may update these terms as the service changes. The “Last updated” date above always reflects the most recent substantive change; continuing to use the site after a change means you accept it.
